1. Acceptance of Terms
By using AtacRide, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.
2. Platform Description
AtacRide is an online marketplace that connects riders with guides who offer motorcycle tours, training, and experiences. AtacRide facilitates bookings and payments but is not a party to the agreement between rider and guide.
3. User Accounts
AtacRide supports two primary user roles:
- Riders — Users who browse, book, and participate in motorcycle experiences.
- Guides — Users who create listings, host tours, and offer training sessions. Guides must be approved by AtacRide before publishing listings.
Users must be at least 18 years old and provide accurate, complete information during registration.
4. Guide Responsibilities
Guides are responsible for:
- Providing accurate descriptions, photos, and route information for their listings.
- Holding valid licenses, permits, and insurance required for the services offered.
- Ensuring the safety and well-being of riders during the trip.
- Complying with all local laws and regulations in the country where the trip takes place.
- Maintaining a connected Stripe account in good standing to receive payouts.
- Responding to bookings and messages in a timely manner.
5. Bookings & Payments
Payments are processed securely via Stripe. Prices are listed per person in EUR. AtacRide charges a platform fee of 7% on each booking, deducted from the guide's payout. When a rider pays, funds are held on the platform's Stripe account (escrow) and released to the guide only after the trip is completed or 72 hours after the trip date (see Section 6).
6. Escrow & Payout Policy
When a rider pays for a booking, the full amount is held by AtacRide on the platform's Stripe account. The guide does not receive their payout immediately. Payouts are released according to the following process:
- Payment is captured immediately when the rider books, and held on the platform's Stripe account.
- After the trip date has passed, the rider can click "Mark as Completed" in their dashboard to release the payment to the guide immediately (manual release).
- If the rider does not mark the trip as completed, the payout is automatically released 72 hours after the trip date (failsafe), provided no claim has been filed.
- If the rider files a claim (refund, complaint, or guide report) within the 72-hour window, the payout is halted and the claim is reviewed by AtacRide admin.
- The admin will resolve the claim by either refunding the rider or releasing the payout to the guide.
The 7% platform fee is automatically deducted before the payout is transferred to the guide.
This escrow model protects both parties: the guide is guaranteed payment if the rider doesn't show up (and didn't cancel within the free window), and the rider has a 72-hour window to report issues before money is released.
7. Cancellation Policy
Each guide sets their own cancellation deadline (in days) on their listing (default: 3 days). Riders may cancel free of charge up to that deadline — a full refund is processed automatically. After the cancellation deadline has passed, riders can no longer cancel the booking. If the rider does not show up and did not cancel in time, the guide is still eligible for payout (subject to the 72-hour release in Section 6). If a guide cancels a trip, riders receive a full refund. Refunds are processed via Stripe and may take 5–10 business days.
8. Platform Fee Disclosure
AtacRide charges a 7% platform fee on each completed booking. This fee is deducted from the guide's earnings before payout. For example, on a €100 booking, the guide receives €93 and AtacRide retains €7. This fee covers payment processing, escrow holding, platform maintenance, and customer support.
9. Prohibited Conduct
Users must not:
- Use the platform for any illegal or unauthorized purpose.
- Submit false, misleading, or fraudulent information.
- Harass, abuse, or discriminate against other users.
- Circumvent the platform's payment system or attempt to transact outside of AtacRide.
- Impersonate another person or misrepresent their qualifications.
- List experiences that are illegal, dangerous, or violate local regulations.
Violations may result in account suspension or permanent removal from the platform.
10. Prohibited Activities
Guides may not solicit or accept payments from riders who discovered them through AtacRide outside of the AtacRide platform. This includes but is not limited to: sharing external payment links, bank account details, or directing riders to external booking systems.
- First violation: written warning
- Second violation: listing suspension
- Third violation: permanent account ban
AtacRide reserves the right to suspend any account immediately if circumvention is confirmed.
11. Liability Limitations
AtacRide is a marketplace, not the service provider. AtacRide is not responsible for the conduct, actions, omissions, or services of any guide or rider on the platform. We do not guarantee the quality, safety, or legality of any trip, tour, or training session.
All trips and experiences are undertaken at the participant's own risk. To the maximum extent permitted by law, AtacRide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the platform. AtacRide's total liability for any claim arising from these terms shall not exceed the platform fee collected on the relevant booking.
12. Claims & Disputes
If you have an issue with a booking (e.g. the guide didn't show up, the trip wasn't as described, or you experienced unsafe behavior), you may file a claim through your Rider Dashboard → Trips → File a Claim. You must file within the 72-hour claim window after the trip date. Filing a claim immediately halts the automatic guide payout. An AtacRide admin will review the claim and resolve it by either refunding the rider or releasing the payout to the guide.
13. Account Suspension
AtacRide reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent behavior, or pose a risk to the community.
14. Governing Law
These Terms & Conditions are governed by the laws of Austria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Austria.
15. Changes to Terms
AtacRide may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the updated terms.
